Before QTI, also doing business as QuVis, can proceed with DCP packaging services, you must review and agree to these terms and conditions.
I, me, mine or my refers to you, the customer.
I represent and warrant that my request for DCP packaging services and all materials submitted are not and will not later be in violation of any copyright laws. I will indemnify and hold QTI harmless against any claims or demands by any third party and any expenses (including QTI’s reasonable attorney fees).
I certify that I am not a national of Cuba, Iran, North Korea, Sudan or Syria or any country to which the United States embargoes goods or services. I am not acting on behalf of any such country, national or individual or entity.
I understand that QTI is not liable for the acts or omissions of third parties, unforeseen events, acts of God, labor disputes, equipment or power failures, or any event, action or omission over which QTI has no direct and immediate control. QTI is not liable for lost, damaged or misdirected mail regardless of the mail format. QTI, unless otherwise agreed in writing, has no obligation to keep a copy of the materials submitted for conversion.
I further understand and agree that under no circumstance QTI will be liable for any loss of use, interruption of business, or any direct or indirect, special, incidental or consequential damages of any kind (including lost profits, unauthorized use or divulgation or release of the media except for the limited warranty stated in this agreement.
I understand and agree that under no circumstances QTI will be liable for any damages in excess of the price of the packaging services whether the claims sound in torts, in contract, or consumer law.
QTI provides a limited warranty against defects in material and workmanship. As my sole remedy and QTI’s sole liability, QTI will repair, replace or refund the purchase price, at its sole discretion, of any media support products returned by me and found to be defective by QTI. I agree that this limited warranty is also limited in time and that I must return the defective product to QTI within thirty (30) days.
I understand and agree that, to the extent permitted by law, QTI disclaims any and all implied or expressed warranties not specifically stated in these terms and conditions.
Without limiting any of the preceding statements, I understand and agree that QTI will exercise reasonable care in handling and, if I so choose, returning the original media. I also understand and agree that DCP Packaging Services used by QTI are designed to be transparent to the source but that the visual or acoustic quality of the converted material compared to the original maybe influenced by the quality and format of the original I have submitted to QTI. QTI agrees in handling my media, to exercise ordinary care but QTI is not the custodian or guarantor of the integrity or quality of the media or material submitted for packaging or conversion services.
QTI will accept order cancellations without penalty up until QTI begins work on the conversion or serviced ordered. If work has begun, QTI will prorate, in its sole discretion, the charges for the work already done and costs already incurred and I agree to pay those charges and costs.
I understand that pricing is subject to change until my order is placed and the material received by QTI. If the price changes, QTI shall contact me prior to beginning the work on my order.
If any provision of this agreement is found to be unenforceable, invalid or void by a court of law, such provision will be deemed severed from this agreement and all other provisions of this agreement will remain in full force and effect.
This agreement shall be governed by the laws of Kansas and jurisdiction shall lie exclusively in the courts of Kansas.
This agreement contains the entire agreement between I and QTI concerning the packaging services or conversion services and all ancillary services. No prior understanding or representations, either written or oral, supersede the terms of this agreement. Any amendment or modification of this agreement must be in writing and accepted in writing by QTI.
